Marketing-affiliates in Holland alerted of penalties by Dutch regulatory authority

The KSA recognizes that gambling operators often utilize affiliate websites for advertising their offerings. These websites typically feature banner ads and text links that users can click on to visit the gambling sites. However, the KSA acknowledges that this advertising method doesn’t always comply with Dutch advertising regulations. To address this issue, the KSA sent a letter to affiliates requesting them to ensure that their websites adhere to the national laws. The KSA emphasizes that affiliates should only advertise gambling sites that are operated by licensed operators authorized to offer online games of chance in the Netherlands. Failure to comply with this requirement may result in regulatory action, including financial penalties. While advertising is permitted for licensed operators, affiliates must ensure that their ads comply with regulations. These regulations include avoiding targeting minors or young adults under the age of 24 and clearly indicating which operator is being promoted. The KSA believes that affiliate websites play a crucial role in promoting better compliance with advertising regulations for gambling companies, contributing to enhanced consumer protection. The Dutch Minister for Legal Protection, Franc Weerwind, recently announced that the KSA has launched an investigation into operators’ advertising practices targeted at players aged between 18 and 24. Weerwind addressed concerns raised by MPs Michael van Nispen and Mirjam Bikker regarding bonuses and the licensing process in the country. He mentioned that while the KSA examines the advertising practices of operators towards younger customers, it recognizes that bonuses can still be a useful tool if used responsibly.
