Last month, a law was passed in Peru’s Congress with overwhelming support, receiving 91 votes in favor and no opposing votes. This law was recently signed and published in Peru’s official newspaper, El Peruano. It is set to take effect in 60 days after its publication.
The newly enacted law designates the Ministry of Foreign Trade and Tourism of Peru (Mincetur) as the official regulator for gambling activities in the country. Mincetur will hold the authority to monitor all gambling operations, including the ability to block URLs and IP addresses that violate the law. Additionally, they will ensure the proper functioning of all technological software and hardware used in online gambling.
The tax rate imposed by this law has been determined at 12% of the total tax base, which will be collected on a monthly basis. The total tax base is calculated by subtracting maintenance costs from the net income. Sunat, Peru’s customs and tax body, will oversee the monitoring and collection of this tax.
Operators will also be subject to a monthly maintenance tax equivalent to 2% of their income. Failure to comply with the law may lead to various penalties, including fines of up to SOL200 (£42.79/€50.47/$51.24), freezing of assets, or even disqualification of their gambling license for a period of up to 10 years or permanently.
