The regulator has received complaints from sports bettors regarding operators refusing to take their bets.
According to the ANJ, refusing to provide a service to a consumer is prohibited under article L. 121-11 of the French Code of Consumption.
Operators who violate this article can be fined up to €1,500, which may be increased to €3,000 for repeat offenses.
The ANJ also ruled that refusing bets could be considered deceptive marketing tactics.
Deceptive marketing, as defined by article L. 121-2 of the French Code of Consumption, involves false or misleading claims about the existence, availability, or nature of a good or service.
Offenders could face a maximum penalty of two years in prison and a fine of €300,000.
The ANJ concluded that operators cannot refuse bets from players unless they have a legitimate reason under article L. 121-11 of the French Code of Consumption.
Legally defined legitimate reasons may include refusing bets from minors, self-excluded individuals, or excessive bettors.
