The new government, taking over today, along with the regulator de Kansspelautoriteit (KSA), should conduct a thorough analysis of the possibilities and effects of these advertising restrictions. It is essential to consider the delineation of ‘untargeted advertising’ and which media outlets will be affected. Operators are reminded of their obligation to adhere to strict advertising rules to protect socially vulnerable groups, including minors and young adults. The KSA should be responsible for implementing and maintaining a designated time slot for advertising.
The current media act already includes two windows that prohibit gambling advertising on radio and TV (6am to 9pm) and on TV for low-risk games (6am to 7pm). From February 1, 2021, all TV channels in the Netherlands will limit gambling ads to thirty seconds. MP Dekker, who will step down today, emphasized the importance of following these rules.
